Motion to Dismiss Joel Lawsuit Summarily Denied

On December 6, 2011, this newspaper's motion to dismiss the Joel lawsuit was summarily denied by Judge Hayes.

For observers in the courtroom, Judge Hayes was not even listening to the arguments and asked no questions. He immediately announced his decision.

Judge Hayes was a friend of Glenn Tucker and offered a glowing eulogy at Tucker's funeral. And as we know, Tucker protected and condoned the violations of the Clean Water Act and Clean Air Act at the time when Joel was the Public Works Director.
